General Terms and Conditions (GTC)

These general terms and conditions apply to all deliveries by SmithWorks Europe GmbH to consumers (GTC). A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly neither be attributed to their commercial nor their independent professional activity.

The purchase contract is concluded with SmithWorks Europe GmbH, Langenstück 5, 58579 Schalksmühle, Germany; registerd at: court of Iserlohn, Germany, no. B9865.

The presentation of the products in the online shop does not represent a legally binding offer, but only an invitation to order. By clicking the button [buy / order for a fee] you place a binding order for the goods listed on the order page. The order confirmation that you receive immediately after placing the order is only used to inform that we have received your order and does not yet constitute an acceptance of the contract. Your purchase contract is only concluded when we have confirmed your order with an invoice and shipping information and sent it by email.

The prices stated on the product pages include the statutory value added tax and other price components. The stated prices are independent of the selected payment method. In addition to the prices quoted, we also charge shipping costs for the delivery. These are based on the delivery address provided and are automatically calculated in the order summary.

The following shipping costs are calculated in the respective zone:

From a value of goods minus discounts of € 250 per order, shipping in zone 1 is free of charge.

Countries: Austria, Belgium, Bulgaria, Croatia, Cypruss, Czech Republic, Denmark, Estonia, Finnland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden

From a value of goods minus discounts of € 250 per order, shipping in zone 2 is free of charge.

Zone 3 - € 17,90
Countries: Liechtenstein, Norway, Switzerland

The shipping costs are communicated to you in the summary of our order pages. There are no additional taxes or costs for deliveries within the EU. For deliveries outside the EU depending on the country, additional customs duties or import sales tax may apply, which the buyer takes on at his own expense.

The delivery takes place with the Deutsche Post, the parcel service DHL Paket or the freight carrier DHL Freight. All deliveries are insured up to the value of the consignment including VAT. The delivery time is usually around 2 working days in Germany and up to 5 working days in the EU after the first working day of the order. We point out any deviating delivery times on the respective product page or in the receipt email of your order.

The available payment methods may vary depending on the country in question. When selecting a payment method, the respective provisions of the provider of the selected payment method apply.

The goods remain the property of SmithWorks Europe GmbH until they have been paid in full.

The statutory warranty claims according to §437 ff. BGB (Germany) and the current case law apply.

By placing an order, the customer agrees that his e-mail address or telephone number (optional) will be sent to the parcel sender so that they can contact the recipient before the goods are delivered for the purpose of coordinating a delivery date or status information can transmit for shipment delivery. The consent given can be revoked at any time.

By placing an order, the customer agrees that we will automatically send the invoice for the order as a PDF file attached to the order confirmation to the email address provided. The consent given can be revoked at any time.

The following conditions apply to all coupons (as part of discount and special promotions) from www.smithworks.golf unless otherwise stated.

Usability
Each coupon as part of a discount and special campaign can only be used and redeemed once. Only one coupon can be used per order as part of a discount and special offer. Only one coupon can be redeemed per customer per purchase. A combination with other coupons / vouchers is not possible. A cash payment or retroactive crediting of coupon orders that have already been placed is not possible. Coupons can only be used on www.smithworks.golf for the products offered there. The resale of coupons is not permitted. Articles that are queried as part of a PreOrder query are excluded from this offer. Coupons are not counted towards shipping costs. If the purchase amount in the shopping cart falls below the value of the coupon, the remaining amount is forfeited.

Validity
Coupons are only valid for a limited time and expire on the date stated with the coupon. An extension is not possible.

Minimum order value
In some cases, SmithWorks sets a minimum order value from which the coupon can be redeemed. If so, SmithWorks will notify you along with the coupon.

Return of articles
If you make use of your right of return, the reduced purchase price will be refunded. There is no entitlement to a refund or replacement of the coupon.

Redemption
After completing the shopping process you will find the "Enter code" area at the end of your shopping cart. Here you can enter the code in the empty field. By clicking on "Apply discount code", the voucher or discount amount will automatically be deducted from your order value.

The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a point of contact for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute settlement procedure before a consumer arbitration board.
